These terms govern purchases from GiddyGadget.com, Cherrytree Drive, Brampton, ON L6Y 3P1. By placing an order you accept them.
Who can order
You must be at least 18, or the age of majority where you live if that is higher, and legally able to enter into a contract. We ship to addresses in Canada and the United States only. If you are ordering for someone else, you are the one agreeing to these terms.
Prices, currency and tax
- All prices are shown and charged in USD, wherever you are ordering from. If your card is issued in another currency, your bank sets the exchange rate and may add its own foreign-transaction fee. Refunds are made in USD too, so the amount that lands back on your card can differ slightly from what left it.
- Prices are shown excluding tax. On orders shipping to Canada, GST/HST is added at checkout at the rate for the destination province and shown before you pay. On orders shipping to the United States, we do not charge sales tax.
- Customs may charge duty or tax at the border on top of any of the above. What that means, and what we reimburse, is set out in our Shipping Policy.
- Shipping is charged as set out in our Shipping Policy.
- If a product is listed at an obviously incorrect price, we may cancel the order and refund you in full rather than fulfil it. We will always tell you before doing so.
Orders and delivery
Your order is an offer to buy. It is accepted when we send the confirmation email. Stock and delivery estimates are not guarantees — items are fulfilled by overseas partners, and how long that takes varies a great deal by item: the estimate shown on the product page you ordered from is the one that applies to your order. If an order has not arrived 30 days after the latest date in the estimate you were given, you can cancel it for a full refund or ask for a replacement. If we cannot fulfil an order we will refund it in full.
Discounts and coupons
Welcome-offer coupons are single-use, one per person and per email address, cannot be combined with any other coupon, and do not apply to sale items — including the Product of the Week. Coupons have no cash value and expire on the date stated in the email.

Using this site
Please do not: order with a payment method you are not entitled to use; open multiple accounts or email addresses to reuse a single-use coupon; scrape, copy or republish our catalogue, photography or copy at scale; place bulk automated orders; or try to interfere with, overload or gain unauthorised access to the site. Product reviews and any other content you submit must be your own and lawful, and you give us permission to publish it here.
Accounts, suspension and termination
You are responsible for keeping your account password to yourself. You can close your account at any time by emailing us. We may refuse or cancel an order, or suspend or close an account, for payment fraud, coupon abuse, repeated unfounded chargebacks, or a breach of the section above — and we will tell you why. If we do, you still get your money back for anything you paid for and did not receive: cancelling an order is never a way for us to keep your payment.
Intellectual property
The GiddyGadget.com name and logo, this site’s design, and our own photography and written copy belong to us. You may not copy or reuse them commercially without our permission. Brand and product names that appear in listings are the trademarks of their respective owners; we use them only to identify the item being sold, and that does not imply any affiliation with or endorsement by the brand owner.
Notice and takedown. If you own a trademark, copyright or design right and believe a listing on this site infringes it, email info@giddygadget.com with the listing URL, what right you hold and how to verify it, and how to reach you. We will remove the listing from sale while we look into it — normally within two business days of receiving a credible complaint — and tell you what we found. We would rather delist an item than argue about one.
Liability
We sell consumer goods for ordinary domestic use. To the extent permitted by law, our total liability for any order is limited to the amount you paid for it. Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or any right you have under the Consumer Protection Act, 2002 (Ontario), the consumer protection law of your own province, or the consumer protection law of your state if you are in the United States.
Events outside our control
We are not liable for delay or failure caused by something genuinely beyond our reasonable control — customs holds, carrier or postal disruption, severe weather, strikes, supplier failure, war, epidemic, or a large-scale network or power outage. We will tell you what is happening and what we are doing about it. This does not extend the 30-day non-delivery refund in our Shipping Policy: if the delay means your order does not arrive, you get your money back.
If part of these terms does not hold
If a court finds any part of these terms unenforceable, that part is read down to the least extent needed to make it valid, or removed, and everything else stays in force. Not enforcing a term on one occasion does not waive it.
Governing law and your consumer rights
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and we will bring any claim of ours there. That does not take away the consumer protection law of the place you live, which applies notwithstanding this clause. If you are in Quebec, you keep your rights under Quebec law and may bring proceedings in Quebec. If you are elsewhere in Canada, your province’s consumer legislation applies to you. If you are in the United States, your state’s consumer protection statutes apply to you. Nothing in these terms is a waiver of any of that.
